Bennington FAY, David Vermont Historical Magazine, No XI, October 1867, p 172 (extracted from a section dealing with the history of Bennington) David FAY, youngest son of Stephen FAY, was born 13 December 1761 at Hardwick [Worcester County], Massachusetts, and came to Bennington [Bennington County, Vermont] as one of his father's family in 1766. He was in the battle of Bennington, though less than sixteen years old, his name being found on the roll of Capt. Samuel ROBINSON's company, designated as "fifer." He was admitted to the bar in June 1794 and was States Attorney for four years previous to 1801, was United States Attorney for the Vermont District under Mr. JEFFERSON, Judge of the Supreme Court for four years from 1809, Judge of Probate in 1819 and 1820, and a member of the Council for four years ending in 1821.
